Your Relationship with eBarsa

The use of products, services and applications made available by eBarsa is subject to the terms of a legal agreement established between you and eBarsa Tecnologia Ltda, the company responsible for the development and maintenance of eBarsa software. This document details how the agreement is formalized and regulates the terms applicable to the use of the Services.

Unless otherwise indicated in writing, the agreement between you and eBarsa includes, at a minimum, the general terms described in this document (hereinafter, 'Universal Terms'). In addition, the agreement may include other specific terms applicable to certain services (hereinafter, 'Additional Terms'). When applicable, Additional Terms will be presented in the context or during the use of the Services.

The Universal Terms and Additional Terms jointly form a legally binding contract between you and eBarsa. We recommend reading them carefully, as this contract governs the use of all Services.

In case of conflict between Additional Terms and Universal Terms, Additional Terms shall prevail regarding the specific service in question.

Acceptance of Terms

To use eBarsa Services, you must accept the Terms. If you do not accept them, you cannot use the Services.

Acceptance of Terms can be done in the following ways:

Clicking on the option to accept or agree to the Terms, when presented in the user interface; or
Using the Services. By using them, you acknowledge and agree that eBarsa will consider this as acceptance of the Terms.

You may not use the Services if:

You are not of legal age to form a binding contract with eBarsa; or
You are a person barred by law from using the Services under the laws of your country of residence or the country where you use the Services.

We recommend that you save or print a copy of the Universal Terms for future reference.

Services Provided by eBarsa

eBarsa is constantly evolving to offer better experiences to its users. Thus, there may be changes in the form and nature of the Services without prior notice.
In addition, eBarsa reserves the right to, at any time, temporarily or permanently suspend the Services without prior notice. Users can also stop using the Services at any time without notifying eBarsa.
If your account is suspended, you may be prevented from accessing the Services, as well as data or content associated with your account.

Use of Services

To use the Services, you may be asked to provide personal information as part of the registration process or continued use. It is mandatory that this information be true, correct and updated.

You may not:

Access the Services by unauthorized means or different from the interface provided by eBarsa;
Interfere with or disrupt the operation of the Services or associated networks;
Reproduce, duplicate, sell or resell the Services without formal authorization.

By using the Services, you agree to receive notifications and communications from eBarsa, including alerts and information about features.

Account Security and Passwords

You are responsible for maintaining the confidentiality of your account and associated passwords. eBarsa is not responsible for unauthorized access to your account due to failures in maintaining this confidentiality. If you identify unauthorized use of your account, you must inform eBarsa immediately.

Privacy and Personal Information

Intellectual Property

All legal rights, titles and interests related to the Services, including intellectual property rights, are the exclusive property of eBarsa, unless otherwise specified. Users are not allowed to use eBarsa trademarks, logos or distinctive signs without formal authorization.

Termination of Agreement

The agreement between you and eBarsa can be terminated at any time:

By your initiative, by closing accounts associated with the Services; or
By decision of eBarsa, in case of violation of Terms or in situations where Services cease to be offered in your region.

Exclusion of Warranties

The Services are provided 'as is', without express or implied warranties of any kind. eBarsa does not guarantee that the Services will meet your expectations or that they will be uninterrupted and error-free.

Limitation of Liability

eBarsa will not be liable for:

Indirect or consequential losses, such as loss of revenue, data or reputation;
Damages resulting from interruptions in Services, deletion of data or unauthorized access.

Modifications to Terms

eBarsa may change the Terms periodically. Whenever this occurs, a new version will be presented for you to continue using the Services.

Final Provisions

The Terms shall be governed by the applicable laws of your country of residence. Any conflicts will be resolved in competent courts.
